Stealing Evidence

Ethically Representing Clients Who Record Conversations, Copy Documents, and Download Files

When a client walks into a lawyer's office with secretly-recorded conversations, stolen documents and downloaded data files, the lawyer must be prepared to deal with complicated legal and ethical issues.  What if the documents contain attorney-client privileged information?  Or HIPAA-protected medical information?   What if the client violated federal criminal laws by downloading data from computers he was not authorized to access?

​Acting improperly can not only damage the client's case, it can also subject the lawyer to disqualification, malpractice claims, ethics complaints, and even criminal charges.

This program explains the ethical rules applicable to stolen evidence, and provides guidance on how to protect yourself and your client.  You will learn the questions you must ask, and the steps you must take, before you start reviewing documents from unknown sources.

As a young associate at a large law firm, John Howley was assigned to work on a pro bono death penalty case.  What he saw was shocking and led him to volunteer for more than a dozen death penalty cases.  Reviewing his extraordinary record of success, The New York Law Journal wrote, "The best news a death row inmate can hear is that John Howley has agreed to accept his case."
